User Privacy Agreement for APP Use

We hereby specially remind you (User) that before registering as a user, please carefully read this “Privacy Agreement” (hereinafter referred to as the “Agreement”) to ensure you fully understand all its terms. Please read it carefully and choose to accept or reject this Agreement. Your registration, login, use, and other actions will be deemed as acceptance of this Agreement and agreement to be bound by its terms. This Agreement stipulates the rights and obligations between Guangdong Qianwei Instrument Co., Ltd. (hereinafter referred to as “Qianwei Instrument”) and users regarding the “SmarTexLab” software service (hereinafter referred to as the “Service”). “User” refers to individuals who register, log in, and use this Service. This Agreement may be updated by SmarTexLab at any time, and the updated terms, once published, shall replace the original terms without further notice. Users can view the latest terms of the Agreement in this APP. After modifying the terms of the Agreement, if a user does not accept the modified terms, please immediately stop using the services provided by Qianwei Instrument. Continued use of the Service shall be deemed acceptance of the modified Agreement.

I. Protection of Users’ Personal Privacy Information

1、 If SmarTexLab discovers or receives reports or complaints from others that a user has violated the provisions of this Agreement, it has the right to review and delete relevant content, including but not limited to user profiles and posted data, at any time without notice, and impose penalties on violating accounts, including but not limited to warnings, account bans, device bans, and function bans, and notify users of the outcome.

2、 Users whose accounts have been banned due to violating the user agreement may contact SmarTexLab themselves. Among them, users whose functions have been banned will automatically have their banned functions restored after the ban period expires. Banned users may submit appeals, and SmarTexLab will review the appeals and make reasonable judgments on whether to change the penalty measures.

3、 Users understand and agree that SmarTexLab has the right to penalize behaviors that violate relevant laws, regulations, or the provisions of this Agreement based on reasonable judgment, take appropriate legal action against any user who violates laws and regulations, and save relevant information for reporting to relevant departments in accordance with laws and regulations. Users shall bear all legal responsibilities arising therefrom.

4、 Users understand and agree that any claims, demands, or losses, including reasonable attorney’s fees, made by any third party due to or arising from the user’s violation of this Agreement, shall be compensated by the user to SmarTexLab and its cooperating companies and affiliated companies, and shall exempt them from damage.

5、 Without obtaining users’ explicit consent, SmarTexLab will not associate with personal identity information or any permanent device identifiers (such as SN, MAC address, IMEI, etc.). The acquisition of mobile device information is for accurately analyzing user groups and providing users with professionally customized operational services.

II. Norms for User-Posted Content

1、 The content mentioned in this clause refers to any content created, uploaded, copied, published, or disseminated by users during the use of the Service, including but not limited to registration information and certification materials such as account avatars, names, and user descriptions, or text, voice, images, videos, graphics and text, sent, replied to, or automatically replied to messages and related link pages, as well as other content generated by using the account or this Service.

2、Users must not use “SmarTexLab” accounts or this Service to create, upload, copy, publish, or disseminate content prohibited by laws, regulations, and policies.

3、Users must not use “SmarTexLab” accounts or this Service to create, upload, copy, publish, or disseminate content that interferes with the normal operation of the “Service” and violates the legitimate rights and interests of other users or third parties.

III. Usage Rules

1、 Any content transmitted or published by users in or through this Service does not reflect or represent, nor should it be deemed to reflect or represent, the views, positions, or policies of SmarTexLab, which bears no responsibility for it.

2、 Users must not use “SmarTexLab” accounts or this Service to engage in the following behaviors:

(1) Submitting or publishing false information, or stealing others’ avatars or information, impersonating or using others’ names;

(2) Forcing or inducing other users to follow, click on link pages, or share information;

(3) Fabricating facts or concealing the truth to mislead or deceive others;

(4) Using technical means to establish false accounts in bulk;

(5) Using “SmarTexLab” accounts or this Service to engage in any illegal or criminal activities;

(6) Creating or publishing methods or tools related to the above behaviors, or operating or disseminating such methods or tools, regardless of whether these behaviors are for commercial purposes;

(7) Other behaviors that violate laws and regulations, infringe upon the legitimate rights and interests of other users, interfere with the normal operation of “SmarTexLab,” or are not expressly authorized by the Service.

3、 Users are solely responsible for the authenticity, legality, harmlessness, accuracy, and validity of the information transmitted using “SmarTexLab” accounts or this Service. Any legal responsibilities related to the information disseminated by users shall be borne by the users themselves and have nothing to do with SmarTexLab. If this causes damage to SmarTexLab or third parties, users shall compensate accordingly in accordance with the law.

4、 The services provided by SmarTexLab may include advertisements, and users agree to display advertisements provided by SmarTexLab and third-party suppliers and partners during use. Unless explicitly stipulated by laws and regulations, users shall be responsible for transactions based on the advertisement information by themselves. SmarTexLab bears no responsibility for any losses or damages suffered by users due to transactions based on the advertisement information or content provided by the aforementioned advertisers.

IV. Others

1、SmarTexLab solemnly reminds users to pay attention to the clauses in this Agreement that exempt Qianwei Instrument from responsibility and restrict users’ rights. Please read it carefully and consider the risks independently. Minors should read this Agreement under the accompaniment of their legal guardians.

2、The validity, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People’s Republic of China. If any disputes or controversies arise between users and SmarTexLab, they shall first be resolved through friendly negotiation. If negotiation fails, users agree to submit the disputes or controversies to the people’s court with jurisdiction at the domicile of SmarTexLab for adjudication.

3、If any clause of this Agreement is invalid or unenforceable for any reason, the remaining clauses shall remain valid and binding on both parties. The copyright of this “Agreement” belongs to SmarTexLab, which reserves all rights to interpret this “Agreement.”
